Terms & Conditions

These general conditions set out the terms and conditions for using the services offered by Società Agricola Semplice I Moresani di Carmine Monzo & C., with its registered office in Casal Velino, Italy, Loicalità Moresani snc, registered in the business register under no. 04320220652. The services are accessible via the website www.agriturismoimoresani.com and its extensions available through mobile applications.

Before browsing the Site and in any case before using and registering for the online shop section of the Site, users are invited to read these General Conditions carefully. The General Conditions include all notes, legal notices, information notices or disclaimers published on the Site regarding the services offered by the Company, as well as the terms referred to through links to this page.

Accessing, browsing and using the Site and its freely accessible features constitutes express acceptance of the provisions of these General Conditions that do not require registration on the Site or its Platforms, and therefore entails an obligation to comply with them.

  • CHANGES AND ADDITIONS TO THE GENERAL CONDITIONS

    • The Company reserves the right, at any time, to amend, supplement and/or cancel, in whole or in part, the Services, policies, these General Conditions and any related documents in order to offer new products or services or to adapt to market needs or legal and regulatory requirements.

    In such cases, we undertake to notify Users of the contractual changes by publishing a notice on the Site's homepage and to update the General Conditions.

    The User undertakes to check the General Conditions regularly and expressly agrees that their use of the Platforms after notification of a change constitutes unequivocal acceptance of those changes.

    These General Conditions of Sale govern the contractual relationships relating to purchases of goods on the website www.agriturismoimoresani.com

    CUSTOMER ELIGIBILITY

    Customers of the Site must be at least 18 years of age and must be natural persons acting for purposes unrelated to any business, commercial, professional or craft activity they may carry out.

    PERSONAL DATA

    The Customer guarantees that the personal data provided during the purchase procedure are accurate.

    The Customer undertakes to notify any changes to the data promptly and to check that the email address provided during registration is working correctly.

    CONCLUSION OF THE CONTRACT

    By submitting the Order electronically, the Customer makes an irrevocable offer to purchase the products selected in the Shopping Basket, expressly requesting fulfilment even without prior acceptance.

    The seller may accept or reject the offer, or accept only part of the quantity indicated, giving notice within 30 days of the date on which the Order was submitted, including by email to the address provided during registration.

    AVAILABILITY AND PRODUCTS

    Product availability is generally indicated on the Site and updated as frequently as possible.

    The parties consider this frequency sufficient to provide reliable information. However, it does not rule out the possibility that a product shown as available when the online Order is placed may not actually be allocated to that Order, or that different dispatch times may be necessary.

    INFORMATION ON CONCLUDING THE CONTRACT

    Pursuant to Legislative Decree 9 April 2003, no. 70, the Customer is informed that, to submit an offer to purchase, they must follow the shopping basket procedure in Italian. This allows them to identify and correct any data entry errors before submitting the order form.

    Once the offer to purchase has been submitted, the supplier will, immediately after accepting it, email the General Conditions of Sale and the "Order Registration Confirmation", containing a summary of the purchased product's characteristics, a detailed statement of the price, the payment method used, delivery charges and any additional costs, together with information on the right of withdrawal if the Customer is a consumer.

    PRICES AND PAYMENT

    The prices published on the Site are expressed in euros and include VAT.

    Payment for the Products purchased may be made using the payment methods described on the Site, particularly in the shopping basket procedure.

    The types of credit card accepted by the supplier will be specified on the payment methods page.

    In the event of withdrawal from or termination of the contract for any reason requiring the amount paid by credit card to be credited back, the supplier will ask the credit card issuer to release the amount. The time required for release depends solely on the credit card issuer.

    DELIVERY COSTS AND TERMS

    The purchased product is delivered to the Customer exclusively within Italy (unless otherwise agreed in writing), to the ground floor of the building at the address provided at the time of purchase, using the carrier Bartolini.

    On receipt of the goods, the Customer must check that the packages are intact and that the quantity and quality of the goods match the accompanying document and the "Order Confirmation" email.

    If any discrepancies are found, the Customer must record them on the copy of the transport document retained by the Carrier and confirm them by registered letter with acknowledgement of receipt or PEC within 14 days of receiving the goods.

    RIGHT OF WITHDRAWAL

    A Customer who is a consumer has the right to withdraw from the purchase contract for the Product without penalty and without giving a reason within fourteen working days of receiving the Product, provided that no customisation of any kind has been applied.

    Saturday is considered a non-working day. If the period expires on a non-working day, it is extended to the next working day. A Customer wishing to exercise the right of withdrawal must notify the supplier by an explicit statement, which may be sent by registered letter with acknowledgement of receipt.

    If the right of withdrawal is exercised, the CUSTOMER must return the goods within 14 days of the day on which they notified their decision to withdraw from the contract, pursuant to Article 57 of Legislative Decree 206/2005. The goods must be returned to Società Agricola Semplice I Moresani di Monzo Carmine & C.

    Località Moresani, snc – 84040 Casal Velino (Sa). The goods must be returned intact, in their original packaging, complete with all parts (including packaging and any documentation and accessories). The supplier reserves the right to check compliance with these requirements and will refund the amount paid for the products covered by the withdrawal within the statutory time limits.

    The Customer bears the cost of returning the Product, while the refund will include delivery charges. The refund will be made by reversing the transaction using the same payment method chosen by the Customer when placing the order.

    COMPLAINTS

    Any complaints must be addressed to Società Agricola Semplice I Moresani di Monzo Carmine & C.

    APPLICABLE LAW

    The purchase contract concluded on the Site is governed by Italian law.

    The court of Salerno has exclusive jurisdiction over any dispute relating to the application, performance or interpretation of this contract. However, where the Customer acts as a "consumer", jurisdiction lies with the court of the place where the Customer resides or has elected domicile.

    HYGIENE AND HEALTH INFORMATION, LABELLING AND COMMUNICATION PURSUANT TO REGULATION (EC) 1169/2011, AS SUBSEQUENTLY AMENDED AND SUPPLEMENTED.

    Società Agricola Semplice I Moresani di Carmine Monzo & C. operates in accordance with Regulation (EC) 852/04. All mandatory information for the marketing of food under Regulation (EC) 1169/2011, as subsequently amended and supplemented, and any other applicable legislation is made available to the consumer before the purchase is concluded, through publication in the detailed description of each product.

    Specifically, Società Agricola Semplice I Moresani di Carmine Monzo & C. makes available, for each product, the name of the food, the list of ingredients including any allergens present, the quantity of certain ingredients or categories of ingredients, known as

    QUID, where applicable, the net quantity, any special storage conditions and/or conditions of use, the country of origin or place of provenance where required under Article 26 of Regulation (EC) 1169/11, the alcoholic strength by volume where required, instructions for use where their omission would make appropriate use of the food difficult, and the nutrition declaration.

    Only the date of minimum durability (TMC) or use-by date and the batch number are provided at the time of delivery, together with the goods, possibly on the invoice or in any case on the food packaging.
